These terms and conditions are intended to define the terms of selling between the brand “POKA SAS” (named “POKA PARIS”) on one hand, and all physical person (named “Customer”) buying on Poka Paris Website on the other hand. These are written in English. They specify in particular the various steps necessary for ordering by Customer, the terms of payment and delivery, and specify the follow-up of the Customer’s order.

Price
The prices of products are those communicated on the website and confirmed to the customer during the validation of the order. They are indicated in euros, and include all taxes, excluding shipping costs (specified that the value tax has been added on the French country, which remains the responsibility of the customer unless mentions or special conditions).
The amount of delivery charges in addition is indicated to the Customer directly on the “delivery” page. They are also mentioned and calculated automatically in the cart. The Products remain the property of the seller until full payment by customer.
We reserve the right to change our prices at any time, but we agree to apply the rates listed on the website at the time of your order. We inform you that in case of a wrong price, obviously derisory (cheap price), whatever the reason (computer bug, manual error, technical error), the order, even validated, will be canceled , which we will inform you as soon as possible. You will then be able, if you wish, to reorder your order at the corrected and exact price.

Order
POKA PARIS will honor orders received only within the limits of available stocks. In case of out of stock for one or more products POKA PARIS will inform the Customer as soon as possible. POKA PARIS does not incur any liability in the event of out of stock or unavailability of products.
Ordering on the website is subjected to the respect of the procedure set up by POKA PARIS including successive steps leading to the validation of the order. The buyer wishing to buy a product or service must:
Step 1 : the Customer adds the selected products to his cart. Access to cart is possible at any time to modify or validate it. The cart located at the top right of the screen informs the Customer that it has taken into account the selections by indicating the number of products it contains.
Step 2 : the Customer checks the details of his cart which he can modify at any time and validate it. The total amount of the order includes at this step only the price due for the products. Delivery charges will be indicated later during the order validation process.
Step 3 : the Customer creates his Customer account by entering his full details (delivery and billing details). Fields marked with an asterisk (*) are mandatory fields; the billing address will be automatically the same as the delivery address except if the Customer specifies another address.
Step 4 : At the time of validating the order, the Customer expressly accepts the terms and conditions of sale listed on the website.
Step 5 : the Customer chooses his delivery method (the price varies according to the destination) then his method of payment. He is then redirected to the secure payment site where he enters his bank details if he has opted for a payment by credit card. He can also, if he wishes, pay via the secure payment website Paypal. If payment is accepted, the Customer will be redirected to an order confirmation screen on the website. The order by the Customer implies full and unreserved acceptance of the latter to these general conditions of sale. Note that the Customer is debited at the time of the validation of the order and not of his shipment.
Within one hour of placing an order, the Customer will receive an email confirming:
– the registration of his order
– the details of the ordered items
– total all taxes included price
– delivery charges including tax
– an estimated date of delivery time
– the payment method chosen
POKA PARIS reserves the right not to validate the order in case of:
– abnormal orders in relation to strange quantities
– abnormal or abusive exchanges and returns
– existing problem with the Customer
– bank details provided suspicious
The details of the order are archived in accordance with Article L.134-2 of the Consumer Code, for a period of ten years on a secure server. However, no credit card number is kept.

Payment
Payment by credit card
The price of the purchased products is payable in cash, in full on the ordering date by the Customer. Payment is made online, by credit card. The following credit cards are accepted: credit card, visa, Mastercard. The Client’s bank account corresponding to the credit card used for the payment is debited the day of the confirmation of order by POKA PARIS. In the event of a payment default, an incorrect address or any other problem on the Customer’s account, POKA PARIS reserves the right to block the Customer’s order until the problem is solved. All purchases made on the website are protected and secured 7 days a week and 24 hours a day. By clicking on the credit card of your choice, the Customer is directed to the secure payment site STRIPE which integrates the SSL security standard. During the payment, the Customer indicates his card number, its validity date and the cryptogram on the back of credit card. This data is automatically transmitted in encrypted mode (SSL protocol) to be checked to prevent abuse and fraud.
Payment by Paypal
The Customer also has the possibility to pay via PAYPAL secure payment platform. In this case, the Customer will validate the conditions indicated on Paypal page at the time of the transaction. After checking the bank details, Paypal will indicate if the order has been validated or refused.
Payment by bank check
The website POKA PARIS gives the possibility to the Customer not having a credit card to pay by check. In this case, the Customer will have to send a check  with the amount of his puchase included tax, overvalued by the amount of shipping costs (see delivery page) to : POKA PARIS / Service Client, 7 bis bld des loges, 78300 Poissy.

Delivery
POKA PARIS delivers all orders to metropolitan France, and according to specific conditions worldwide. For all orders to be delivered in France the carrier used is Colissimo or Point Relais center. For any delivery in Europe, the carrier is Chronopost. For any international delivery, the carrier is Fedex.
Delivery costs are :
– Free to mainland France with Relais Colis center
– 7,50€ TTC to mainland France delivery home with signature
– 15€ TTC to Europe delivery home with signature
– 25€ TTC to International delivery home with signature
It is the responsibility of the Customer to ensure, upon receipt of the items, their compliance. Any anomaly concerning the delivery such as:
– damaged package,
– missing products,
– damaged products,
– products not conforming to the order,
must be notified within two working days of receipt of the order by letter to:  POKA PARIS, 7 bis bld des Loges, 78300 Poissy or by email to: contact@poka-paris.com. In case of non-compliance, the Customer makes a complaint by email or registered letter in order to obtain a free “return ticket”. The non-conforming article should be sent to the following address:

To get a free return, you can write to contact@poka-paris.com. A printed copy will be provided. It will then print, paste on package and deposit it in “La Poste” or a “Relais Colis” near from your address. Any shipment made by the Customer himself without a written request to the email address indicated above will not give rise to refunds of delivery costs of this return.
It will be appropriate for the Customer to take care of the packaging and to protect the product so that it is not damaged during transport. The product must be returned in its original packaging and condition.

Conformity
All our products are original creations, these are those described on the website on the day of consultation of the website by the user within the limits of available stocks. These products are updated automatically in real time. Any time, an error in the update, whatever its origin, does not engage the responsibility of POKA PARIS. The products are described and presented with the greatest care and as faithfully as possible to best satisfy the Customer’s information. The photographs of the catalog are as faithful as possible, however they can not ensure a perfect similarity with the proposed product, in particular as regards the colors. In addition, it is possible that errors may appear on the website that the Customer recognizes and accepts. The following products are deemed to be non-compliant:

– error on the ordered color
– received model not conforming to the visual of the website
All products benefit from the legal guarantee of conformity (L211-1 and following of the Code of the Consumption) and the guarantee against latent defects (articles 1641 and following of the Civil Code), allowing the Customer to return the defective Products delivered or non-compliant. Article L211-4 of the Consumer Code: The seller is required to deliver a product that complies with the contract and is liable for any lack of conformity existing at the time of delivery. It also responds to any lack of conformity resulting from the packaging, the assembly instructions or the installation when it was charged to it by the contract or was carried out under its responsibility. Article L211-5 of the Consumer Code: To be in conformity with the contract, the property must be fit for the usual use of a similar good and, where appropriate, correspond to the description given by the seller and have the qualities – presented to the buyer as a sample or model; present the qualities that a buyer may legitimately expect in the light of the public statements made by the seller, the producer or his representative, in particular in advertising or labeling or have the characteristics defined by mutual agreement between the parties or be suitable for any special purpose sought by the buyer, made known to the seller and accepted by the seller. Article L211-12 of the Consumer Code: The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods. Article 1641 of the Civil Code: The seller is bound by the guarantee for reasons of hidden defects of the thing sold which render it unfit for the use for which it is intended, or which diminish so much this use, that the buyer would not have not acquired, or would have given a lesser price, had he known them. Article 1648 1st of the Civil Code: The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect. In case of delivery to the Customer of a Product that does not comply with the order or that reveals a hidden defect, the Customer may return the said product to POKA in accordance with the provisions set out above. Returned items must not have been worn / used and must be in their original packaging. They must also be accompanied by the invoice. It is the Customer’s responsibility to arrange proof of this return.
The Customer may ask POKA PARIS:
– to be delivered a product identical to that ordered, within the limits of available stocks;
– to be delivered a product of quality and equivalent price, within the limits of available stocks;
– to be refund of the product ordered. This refund will be made within 15 (fifteen) days from the receipt by POKA PARIS of the returned item, by credit to the bank account of the Customer used to pay the order.

Return
In any case, the above provisions do not deprive the Customer of the possibility of exercising his right of refund, as indicated in the article below. In accordance with Article L 121-20 of the Consumer Code, the Customer has a period of 14 days from receipt of the items ordered to exercise his right of refunf without having to justify reasons or to pay penalties. To return the product, it is sufficient for the Customer to send an email to the following address: contact@poka-paris.com. The email must contain the following elements:

– Email address of the attached account
– Customer name
– Order number
– Reason for return
– Delivery adress
If the Customer uses his right of refund, POKA PARIS will immediately send a receipt of the retraction on a durable way (for example, by email). Return shipping costs are your responsibility except for purchases delivered in France. In the latter case, we will send you a free return voucher by email. Returned product (s) must be new, unused, and in their original box. Any returned item wore and/or damaged by the Customer will not be taken back.

Exception for models sold with your initials: given the unique and personalized nature of the models “create your bag”, these can not be returned or exchanged, in accordance with Article L.121-20-2 of the Consumer Code (“ Le </ em> the right of withdrawal may not be exercised, except where the parties have agreed otherwise, for contracts: […] 3 ° supply of goods made to the consumer’s specifications or clearly personalized or which, from the their nature, can not be reshipped or are likely to deteriorate or expire quickly).

Responsabilities
The responsibility of POKA PARIS for any product purchased on the website is strictly limited to the purchase price of the product. The documents, descriptions and information relating to the Products on the website are not covered by any warranty, express or implied, except as provided by law. POKA PARIS Company is only required to deliver Products in accordance with the contractual provisions. The Products are considered as being in conformity with the contractual provisions if the following conditions are met: they must be in conformity with the description and have the characteristics exposed on the website; they must be suitable for the purpose for which products of this kind are generally designed; they must meet the criteria of quality and strength which are generally accepted for products of the same type and which can reasonably be expected.

Lawsuits
These general conditions of sale are governed by French law. Any dispute that may arise between the Parties due to the formation, interpretation and/or execution of the present will fall, in the absence of amicable settlement, the exclusive jurisdiction of the Commercial Court of Paris.

Partial disability
If one or more stipulations of the present cintract are considered as invalid or declared as such in application of the law, of a regulation or following a final decision of a competent jurisdiction, the other stipulations will retain all their force and their reach.

Modification of these General Conditions of Sale
The present general conditions of sale are applicable on website www.poka-paris.com. POKA PARIS reserves the right to modify them at any time. The new general conditions of sale will be applicable only to orders placed after this modification.
